DOMESTIC AND INTERNATIONAL PACKAGE TOURS | SERVICE AND RESERVATION SALES AGREEMENT

I. PARTIES

This Domestic and International Package Tours | Service and Reservation Sales Agreement ("Agreement");

1- Located at Harem Sahil Yolu Street Mimar Sinan Neighborhood No: 19 A, STM TRAVEL TOURISM AGENCY TRADE LTD. CO. (hereinafter referred to as "STM TRAVEL" within the scope of this Agreement) and;

2- The consumer whose information is provided below, who purchases or undertakes to purchase any package tour, on whose behalf or for whose benefit a package tour is purchased or undertaken to be purchased, or to whom a package tour contract is transferred (hereinafter referred to as "CUSTOMER" within the scope of this Agreement)

is established between.

II. SUBJECT OF THE AGREEMENT

This Agreement regulates the sale of at least two of transportation, accommodation or other tourism services not related to transportation and accommodation services together, for more than twenty-four hours or including overnight accommodation, at an all-inclusive price by STM TRAVEL TOURISM AGENCY TRADE AND LIMITED COMPANY in accordance with Article 51 of the Consumer Protection Law.

The service provided by STM TRAVEL TOURISM AGENCY TRADE AND LIMITED COMPANY within the scope of this Agreement will be referred to as "Package Tour Service" and Package Tour services to be carried out abroad will be referred to as "International Package Tour Service".

III. GENERAL PROVISIONS

III.1 CUSTOMER acknowledges that they have read and become informed about the brochure containing detailed information about the characteristics of the service subject to this Agreement, sales price and payment method and performance; that they will carry their passport valid for at least six months from the tour departure date and having at least two blank pages for entry and exit stamps at border gates, valid visa and identity card for international tours, consent letter and necessary documents if under 18 years old, and photo identity card for Cyprus tours;

III.2 That all responsibility regarding luggage and its contents belongs to them; that they are obliged to follow and control the items they carry; that they will not endanger the life and property safety/integrity of third parties and that they will be personally and primarily responsible for all material/moral damages that may arise if they endanger the life and property safety/integrity of third parties, otherwise STM TRAVEL TOURISM AGENCY TRADE AND LIMITED COMPANY may refrain from performing the service subject to the Agreement and therefore the CUSTOMER has no right of refund; that the cost of all goods and services specified in the field of extra food and beverages, personal expenses and services not included in the package tour price that the CUSTOMER will receive outside the scope of the Package Tour subject to this Agreement will be paid by themselves; that if they terminate the use of the service on the grounds that the performed service is defective, they will notify the reasons for termination in writing to the STM TRAVEL TOURISM AGENCY TRADE AND LIMITED COMPANY official and the hotel where they are staying, due to the obligation to cooperate and act carefully, otherwise they will be deemed to have received and used the service, they accept, declare and undertake.

III.3 CUSTOMER accepts that with this agreement, they are also a party to the agreement on behalf of other persons who will participate in the trip with them and that they are obliged to provide correct information such as names, surnames, T.R. identity numbers of these mentioned persons that will enable them to participate in the trip, that they are obliged and responsible to inform other participants about the preliminary information and brochure content provided to them, and that the brochure given to them is considered to have been given to the participants as well. STM TRAVEL TOURISM AGENCY TRADE AND LIMITED COMPANY accepts, declares and undertakes that the information specified in the brochure and the matters regulated in this Agreement are parallel. Except for the CUSTOMER's fault, an unexpected and unavoidable behavior of a third party, force majeure (adverse weather conditions, road obstacles, strikes, terrorism, fog, possibility of war, unpredictable technical issues, etc.), an unforeseen and unavoidable event occurring despite STM TRAVEL TOURISM AGENCY TRADE AND LIMITED COMPANY/its agent/independent service provider showing all due care, and in these mentioned cases, the CUSTOMER's right to compensation does not arise; if STM TRAVEL TOURISM AGENCY TRADE AND LIMITED COMPANY violates the contract in a way that makes it impossible to continue the contractual relationship, it will immediately refund the contract amount to the CUSTOMER.
